My name is Milo, and I am an international student completing my Master of Social Work in Melbourne. As part of my studies, I am undertaking a placement at Aged care facility, where I have experienced poor management response to a sexual harassment incident. WorkSafe Victoria has advised me to formally report this issue to the HR department with the support of my university.
However, I am deeply concerned that if I raise my concerns, the organization may terminate my placement, which would put my student visa at risk. Since this placement is a mandatory part of my course, losing it could mean I need to extend my visa, which would create significant financial and legal challenges.
I am reaching out to seek your guidance on my workplace rights and what protections I have against retaliation for speaking up. Additionally, I would appreciate any advice or referrals to migration legal services that can help me navigate my visa situation if my placement is affected.

Dear Migrant Workers Centre,
I am writing to formally lodge a complaint regarding my recent employment experience at Terminus Hotel Temora, operated by Gobell Group Pty Ltd (ABN: 22647906385, ACN: 647906385, contact number: 0434 669 799, Email: [email protected]). I believe I have been subjected to serious labor exploitation, including unpaid wages, excessive working hours, unfair dismissal, and coercion using the promise of visa sponsorship.
1. Wage Theft & Unfair Dismissal
Despite my commitment and hard work, the business owner withheld my last two weeks’ wages and never provided payslips. I was also paid the standard rate on weekends and public holidays instead of the legally required penalty rates. I made multiple attempts to address these issues with the owner, but the problems were never resolved. Ultimately, I was unfairly dismissed without any prior notice or explanation.
2. Exploitation Through Visa Sponsorship Manipulation
The owner promised to provide me with a work visa sponsorship to manipulate me into signing documents and working under exploitative conditions. I was led to believe that securing my visa depended on my willingness to work for extended hours without complaint.
3. Excessive Working Hours & Health Impact
Between December 29th and January 14th, I was forced to work 17 consecutive days without a single day off, often up to 15 hours per day. This led to severe sleep deprivation, chest pain, and mental distress. Due to my financial difficulties, I could not afford to seek medical care. The prolonged stress has severely affected my physical and mental well-being, causing psychosomatic symptoms and symptoms of depression.
4. Possible Breaches of Australian Law
I strongly believe that my experience constitutes a violation of Australian labor laws under the Fair Work Act 2009, including:
Unpaid Wages & Wage Theft
Failure to Provide Payslips
Underpayment of Penalty Rates
Unfair Dismissal
Additionally, my case may involve violations under the Migration Act 1958, particularly:
Using visa sponsorship as leverage for labor exploitation
Excessive working hours, possibly constituting forced labor
Request for Assistance
I am reaching out to the Migrant Workers Centre for support in:
Recovering my unpaid wages and seeking legal action against my former employer
Raising awareness about migrant worker exploitation to prevent similar cases
Reporting this case to the appropriate authorities, such as the Fair Work Ombudsman and Australian Border Force
